NOTICE OF ADOPTION OF MACHIAS TOWN BOARD RESOLUTION SUBJECT TO A PERMISSIVE REFERENDUM
Notice Is Hereby Given that at a Meeting of the Machias Town Board held on the 16th day of March, 2026, the Machias Town Board duly adopted a resolution, a true copy of which follows, which resolution is subject to a permissive referendum pursuant to New York Town Law: Machias Town Board Resolution to Reduce the Number of Machias Town Justices from Two Town Justices to One Town Justice March 16, 2026 The following resolution was introduced: Whereas, the Machias Justice Court currently has two Town Justices; and Whereas, the Town of Machias has a population of approximately 2,500 people and many nearby towns with similar or greater populations only have one Town Justice and in light of the historical caseload in the Town, one Town Justice is sufficient; and Whereas, the Machias Town Board believes that in light of the foregoing, it is more economical, efficient and in the best interest of the Town of Machias to reduce the number of Town Justices from two Town Justices to one Town Justice; and Whereas, one of the Town Justice’s term ends at 11:59 PM on December 31, 2027 and the other Town Justice’s term ends at 11:59 PM on December 31, 2029; and Whereas, it is in the best interest of the Town to eliminate the position of the Town Justice whose term ends at 11:59 PM on December 31, 2027, thereby reducing the number of Town Justices from two Town Justices to one Town Justice as of 11:59 PM on December 31, 2027; and Whereas, NY Town Law Section 20 and Section 60-a expressly allow towns to reduce the number of Town Justices. Now Therefore Be It Resolved by the Machias Town Board that based on the foregoing findings, which are incorporated by reference herein, the number of Town Justices is hereby reduced from two Town Justices to one Town Justice effective at 11:59 PM on December 31, 2027, subject to a Permissive Referendum.
Petitions for Permissive Referendum are available at the Machias Town Clerk’s Office located at 3483 Roszyk Hill Road in the Town of Machias, County of Cattaraugus and State of New York during regular business hours of the Machias Town Clerk.
